Terms & Conditions

These Terms and Conditions are applicable to anyone using any facility on the online auction site www.bidlive.net hosted by Auction Lots, W63, 1-9 Barton Road, Bletchley, Milton Keynes, MK2 3HU.  

Use of the site in any way constitutes acceptance of these Terms & Conditions. If you do not agree to be bound by these Terms and Conditions, you may not use the site.

The online auction is operated for the benefit of the beneficiary (Charity, Foundation or charitable organisation) as stated and for whom the Auction is being run.

Items sold within the auction are either donated by the beneficiary or provided by Auction Lots or on occasion by a third party. Each provider holds full responsibility for any item they provide. These responsibilities include accurate descriptions, images, supply and booking, delivery, refunds (if deemed appropriate) or after care.

The winning bidder on each Item, which may include multiple items, offered for sale in the course of the Auction will be the person who has submitted the highest bid at the close of the auction and providing it is in excess of any stated reserve.

All bidders must be capable of forming legally binding relations under applicable UK law. The Auction may not be used by anyone under the age of 18 years old and by any other persons who are legally prohibited from, or otherwise incapable of, entering into binding contracts.

Any bidder using the Auction is, by so doing, confirming that they are legally entitled to do so.

As a bidder you agree that we can process your personal data specifically for this Auction which will include passing to the auction beneficiary, i.e. the charity or foundation.

Our third-party payment provider Stripe securely store your card details and are PCI compliant.

All Items offered in an Auction or raffle are listed and offered for sale on an “as is” basis. Bidders are advised to use due diligence on an Item prior to making a bid. Any questions or concerns should be sent to info@auctionlots.co.uk

Any bid made by a user is an offer to purchase the Item listed at the bid price made by them. Any bidder making a bid for an Item acknowledges and agrees that their offer is an irreversible offer to complete the transaction if they are the winning bidder whereupon the bid will become a contractually binding obligation to purchase the Item at the bid price, although Auction Lots and the beneficiary of the auction have then final decision on whether a bid can be withdrawn on exceptional circumstances.

The ‘winning bidder’ is the person at the end of the Auction to be the highest bidder, provided that their bid meets the reserve. The winning bidder may include any under-bidder who is awarded the Item following the failure of a higher bid for any reason or for sealed bids higher than the reserve on items provided as multiples.

Auction Lots ensure that descriptions and photographs are accurate but many may be representative and it does not guarantee that this is the case, and will not be responsible for any damage or loss caused due to a bidder by reason of a description of an Item being inaccurate, incomplete or for the Item being otherwise in any way different to the bidder’s expectation.

Descriptions of Items are provided without a warranty of any kind. In no event shall Auction Lots or the beneficiary (including its employees, affiliates and volunteers) be liable for any claim, demand or damages arising out of or in any way connected with the use by the bidder of the site, the Auction or their purchase and use of an Item.

Auction Lots & the beneficiary reserves the right in its absolute discretion to amend or change the Item due to circumstances beyond its reasonable control.

After the Auction closes Auction Lots will contact the winning bidder by email to inform the bidder that their bid was the highest and that they are, therefore, the winning bidder.

Either a secure online payment link or information on how payment will be taken will be sent to the winner & payment for the Item must be made within 7 calendar days. Auction Lots or the beneficiary can in its absolute discretion decide, if payment has not been made by the winner within the deadline time stated, to award the Item to the next highest bidder and the original winner will have no right to insist on receiving the Item.

This Agreement between you the bidder, Auction Lots and the beneficiary shall be interpreted and construed in all respects in accordance with English law and any dispute arising in relation to any aspect of the use of the Auction, the Bidding System, bids made by a bidder in the course of an Auction, any Item, payment delivery or any other matter relating to the Auction shall be subject to the exclusive jurisdiction of the English courts to which the parties hereby irrevocably submit.

These Terms and Conditions may be revised and updated by the beneficiary from time to time without notice. Bidders who have previously bid in an Auction on www.bidlive.net are accordingly advised to familiarise themselves with the prevailing edition of these Terms and Conditions when deciding to participate in an Auction. Notwithstanding the foregoing the edition of the Terms and Conditions that was current at the time an Auction commenced will continue to apply throughout that Auction and to all Items sold pursuant to it even if later edition of the Terms and Conditions is implemented before the Auction is completed.

Auction Lots or the beneficiary, due to the nature of these auctions, do not provide refunds. Monies are raised for the beneficiary and go towards that beneficiaries purpose. However, where there is a valid complaint and Auction Lots or the beneficiary deems in its sole discretion and without obligation that a refund or part refund is appropriate Auction Lots or the beneficiary will liaise directly with the bidder. All complaints must be referred to info@auctionlots.co.uk 

Auction Lots will on occasions provide a payment collection service for third parties providing their own auction items. Auction Lots have absolutely no responsibility to provide refunds in such cases. Any dispute passes to the third party involved.

Auction Lots have the right to extend any voucher, if circumstances out of their control affect the winner being able to book within the stated validity. Auction Lots agree to extend any voucher by a minimum of the period affected. For example - A venue closes for a period of 3 months, Auction Lots guarantee a minimum extension of 3 months. Monetary refunds, which can only be for the amount invoiced or paid at auction, will only be paid on agreement between Auction Lots and the buyer if no alternative can be agreed. Auction Lots are not liable for any compensation above the purchase price.
